The New York City Department of Homeless Services ("OHS" or "the Agency") is charged with ensuring " temporary housing assistance for eligible homeless individuals including those who are sex offenders," while also adhering to the requirement to "not refer to a family shelter any family containing a member who .. . is likely to substantially interfere with the health, safety, welfare or care of other residents." In order to ensure the safety of children and families in shelter, it is the policy of the DHS Division of Family Services to determine registered sex offender status at Family Intake, make an individualized assessment of risk to other shelter residents, especially minor children, and assign shelter placements accordingly.
