This Administrative Directive (OMM/ADM) advises social services districts of the January 1, 2005 and January 1, 2006 increases in the following amounts: 1. Maximum protected resource allowance for a community spouse; 2. Community spouse's minimum monthly maintenance needs allowance (MMMNA); 3. Family member allowance; and 4. Personal needs allowance (PNA) for waiver recipients and noninstitutionalized Program of All-inclusive Care for the Elderly (PACE) participants, whose eligibility is determined under spousal impoverishment provisions. These amounts are used in determining the Medicaid eligibility of an institutionalized spouse. This ADM also rescinds GIS 00 MA/027, “Treatment of Institutionalized Spouses’ Social Security Benefits and Requests for Additional Resource Allowances,” which dealt with the Robbins v. DeBuono court decision, and the provisions in 01 OMM/ADM-4, “Spousal Impoverishment Allowance Increases for 2001 and Treatment of Institutionalized Spouses’ Social Security Benefits and Requests for Additional Resource Allowances,” related to Robbins.
