The purpose of this Local Commissioner’s Memorandum is to inform local social services districts that legislation was signed by Governor George Pataki on December 8, 2000, which eliminates the requirement that residents in Assisted Living Programs (ALP’s) be reassessed within 45 days after admission. Chapter 569 of the Laws of 2000 amends Social Services Law Section 461-1 (2) (d) (iii) to eliminate the requirement for reassessment no later than 45 days after a resident is admitted to an ALP.
