09-OCFS-LCM-14: New York State Child Care Block Grant Supplemental American Recovery and Reinvestment Act Allocations for the Period October 1, 2008 through September 30, 2010
The purpose of this Local Commissioners Memorandum (LCM) is to inform social services districts districts) of the first issuance of district allocations of the federal child care stimulus funds that New York State received under the American Recovery and Reinvestment Act of 2009 (ARRA), Public Law 111-5. The LCM also provides program and claiming requirements associated with these federal funds.

As discussed in 09-OCFS-LCM 05 issued by the Office of Children and Family Services (OCFS) on May 6, 2009, New York State has received a one-time award of ARRA child care funds in the amount of $96,785,640. This ARRA award is a federal fiscal year (FFY) 2008-09 appropriation of supplemental discretionary funding under the Child Care and Development Fund (CCDF) that the State must obligate by September 30, 2010 and expend by September 30, 2011. These supplemental ARRA discretionary child care funds have been assigned a special Federal Index or Catalog of Federal Assistance (CFDA) number of 93.713. Of the $96,785,640, OCFS is allocating a total of $84,150,757 to districts. The remainder, or $12,634,883, is funding that has been earmarked by the federal government to support quality expansion and infant and toddler activities and, as such, is being retained by OCFS to implement on a statewide basis.

OCFS intends to allocate the $84,150,757 to districts in two separate issuances. This LCM allocates the first issuance of $42,075,379 for the period October 1, 2008 through September 30, 2010. The delay in issuing the final district allocations of the first issuance was caused by the delay in receiving policy directives, instructions and clarifications from the federal government agencies on the requirements for administering the ARRA funds in general and the specific reporting requirements for the ARRA child care funds. OCFS recognizes that this has impacted the expenditure and claiming of these funds. Therefore, the date for expenditure of the first issuance of the ARRA funds by the districts has been extended to September 30, 2010 from the initial anticipated date of September 30, 2009. Unlike the allocations of New York State Child Care Block Grant (NYSCCBG) funds which must be used for child care subsidies, districts may use some or all of their allocated ARRA child care funds for child care quality improvement projects, provided approval is first obtained from the OCFS Division of Child Care Services. Regardless of whether allocations are used for subsidies or for quality improvement activities, districts should give preference to activities that can be started and completed expeditiously.

OCFS intends to issue a second allocation of the ARRA funds to districts for the period October 1, 2009 through March 31, 2011. However, districts should not anticipate that the amount they will receive in the second allocation will be the same as their allocations for the period October 1, 2008 through September 30, 2010.
