95-04: Issue Code 997; Agency Field NYS6 (01/20/95)

Effective immediately issue code 997 (Varshavsky Litigation) will be assigned as an additional issue code to any Homebound Appellant Represented at a Regularly Scheduled Hearing as distinguished from those at which the homebound appellant participates in a homebound telephone hearing. This is required to comply with the preliminary injunction in Varshavsky and will ensure that all homebound appellants
are afforded equal protection.

Effective January 23, 1995 any issue code 999 (Home Hearing  Requested) and 997 (Varshavsky Litigation) must be coded with an additional agency field of NYS6. This will ensure that Henry Pedicone receives a copy of the Decision After Hearing. If there are three agency fields, NYS6, the fourth agency field, cannot be accepted by the system. It will, therefore, be necessary to add Henry Pedicone, New York State Department Social Services (NYSDSS), Office of Administrative Hearings (OAH), One Commerce Plaza, Albany, N.Y. 12260 as an "Other".
