The notice that will be used by local Departments of Social Services when a client is denied enrollment in a Long Term Managed Care Plan is similar in format to the notice being used when a client is disenrolled.
Unfortunately, this notice went out to clients without any indicator on the form that the issue involves Long Term Managed Care. If requests for hearing are made pursuant to this notice, it may be difficult to determine the issue. One distinctive feature of this notice is the reference to Public Health Law 4403-f. Section 4403-f of the Public Health Law was enacted as part of Chapter 659 of the Laws of 1997 which govern long term managed care plans.
Issue Code 211 has been established for issues related to Long Term Managed Care.
