Disposition Code 85, Appellant Withdrew at Hearing, must be added to the calendar on all cases where the appellant appears before a hearing officer and signs an appellant withdrawal. This disposition relates to the withdrawal of the entire request for hearing and is required for statistical tracking purposes.
Appellant withdrawals of individual issues on heard cases should continue to be noted on the Fair Hearing Data Sheet (FH-019) using Outcome Reason Code 34, as described in OAH Transmittal 98-20.
