This transmittal explains that a new fair hearing "Outcome Reason Code (C-51)" has been created for statewide use and will be applied in cases where the determination of the agency was correct when made but, based on a change in circumstances, is remanded to the agency for some further action, either recomputation or reevaluation. In contrast, Outcome Reason Code C-50 (Agency Action was Correct When Taken) should continue to be used when the Agency is directed to restore or continue the Appellant's benefits." Any Fair Hearing Decisions with an Outcome Reason of C-5 1 have been added to the Varshavsky Remand Monitoring report for review by "Coordinator Code 11."
